CRA Data Breach Settlement Claims Open

Canadians affected by unauthorized access to federal online accounts in 2020 may now claim compensation under an $8.7 million class-action settlement. The claims process opened in August 2026, creating a limited window for eligible individuals to document losses and submit claims.

Eligibility is narrower than class membership

The settlement covers individuals whose personal or financial information in a Government of Canada online account was disclosed without authorization between March 1 and December 31, 2020.

Compensation eligibility is more restrictive. Payments generally apply to individuals affected by unauthorized access between June 15 and August 13, 2020, where personal information was accessed or used fraudulently. Individuals who received a notice from KPMG may also qualify.

Compensation depends on documented impact

Claimants may receive compensation for time spent addressing the breach, with higher amounts available where stolen information was used for fraud.

Claim category

Potential compensation

Information accessed, no fraudulent use

Up to $80

Information accessed and used fraudulently

Up to $200

Eligible out-of-pocket identity-theft costs

Up to $5,000

Claims require timely action

Eligible claimants have until February 3, 2027 to file online or by mail. Supporting records should be assembled early, particularly for claims involving financial losses or identity-theft expenses. Final payments may be reduced if approved claims exceed available settlement funds.

Business Loss Dispute Heads to Court

The former owner of Toronto restaurant Hogtown Smoke is challenging the CRA after it denied business-loss claims arising from the restaurant’s closure. The dispute highlights how documentation can become decisive when substantial losses are reviewed years later.

CRA challenges supporting evidence

Glen Tymchuk says he lost approximately $1.5 million after construction disruptions and COVID-19 contributed to the restaurant’s closure.

The CRA reportedly questioned several elements of the claim, including the business’s status, its Canadian operations and missing shareholder loan documentation.

Records can determine tax outcomes

The case illustrates a broader risk for owner-managed businesses: economic losses alone do not establish tax entitlement. CRA assessments depend on whether taxpayers can substantiate the nature, amount and tax treatment of claimed losses.

Tymchuk has taken the dispute to court, with the case reportedly expected to proceed in 2027 due to existing court backlogs.

Revisiting Past Returns for Refunds

In the latest Tax Mechanic video, Fraser Simpson explains why a filed tax return may still contain opportunities for additional refunds. Canadians can generally request adjustments for returns from the previous 10 calendar years, subject to CRA rules.
